Terms of Use

IMPORTANT: This Agreement is between you and Mysticbits Oü, NOT Apple Inc. Apple is not responsible for the App or its content. By downloading, installing, or using Writify, you agree to be bound by these Terms.

2.1 License

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use Writify on Apple-branded devices that you own or control, as permitted by the Apple App Store Terms of Service.

2.2 Restrictions

You may NOT:

• Copy, modify, or distribute the App
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, lend, sell, or sublicense the App
• Remove, alter, or obscure any proprietary notices
• Use the App for any unlawful purpose
• Transfer your license to another person or device you do not own

3.1 Subscription Features

Writify offers an optional auto-renewable subscription ("Writify PRO") that provides access to premium features including:

• Unlimited AI Library Actions
• Full Wallpaper Library access
• Custom Wallpapers
• AI Chat functionality (when available)
• App Intents integration
• Advanced Features

3.2 Subscription Terms

Billing: Payment will be charged to your Apple ID account at confirmation of purchase. Subscription Periods and Pricing: Writify PRO is available in the following subscription periods:

• Monthly: €3.99 per month (prices may vary by region; e.g., $3.99 USD, £3.99 GBP)
• Annual: €34.99 per year (prices may vary by region; e.g., $29.99 USD, £29.99 GBP)

Annual subscriptions offer approximately 27% savings compared to monthly billing. Auto-Renewal: Your subscription automatically renews unless you cancel it at least 24 hours before the end of the current subscription period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan. Price Changes: Subscription prices may change. If we change subscription prices, we will notify you in advance in accordance with applicable law. Continued use after a price change indicates acceptance of the new price.

3.3 Cancellation and Management

You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase. Cancellation will take effect at the end of the current billing period. No refunds will be provided for partial subscription periods. To cancel:

1. Open the Settings app on your device
2. Tap your name, then Subscriptions
3. Select Writify PRO
4. Tap Cancel Subscription

3.4 Free Trial

If we offer a free trial, it will convert to a paid subscription at the end of the trial period unless cancelled at least 24 hours before the trial ends. Any unused portion of a free trial will be forfeited when you purchase a subscription.

4.1 Nature of AI Output

Writify uses Apple Intelligence and other AI technologies to assist with writing and content generation. AI-generated content is produced algorithmically and may:

• Contain inaccuracies, errors, or outdated information
• Not reflect human intent or professional judgment
• Produce unexpected or inappropriate results

4.2 User Responsibility

YOU ARE SOLELY RESPONSIBLE for reviewing, editing, and verifying any AI-generated content before use. AI outputs should NOT be relied upon as:

• A sole source of truth or factual information
• Professional advice (legal, medical, financial, or otherwise)
• Verified or fact-checked content
• Original work without review

4.3 No Warranty on AI Output

WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, OR SUITABILITY OF AI-GENERATED CONTENT. Use of AI features is entirely at your own risk.

4.4 Copyright and Ownership

Content generated using AI tools may have limited or no copyright protection under current law. You acknowledge that:

• AI-generated content may not be eligible for copyright registration
• You are responsible for ensuring your use of AI-generated content complies with applicable laws
• We do not guarantee exclusive rights to any AI-generated output

5.1 Your Content

You retain ownership of any documents, text, and other content you create using Writify ("User Content"). By using the App, you grant us a limited license to process and store your content solely for the purpose of providing the Service.

5.2 Prohibited Content

You agree NOT to create, store, or transmit content that:

• Is illegal, harmful, threatening, abusive, or harassing
• Contains hate speech, discrimination, or promotes violence
• Is defamatory, obscene, or pornographic
• Infringes intellectual property rights of others
• Contains malware, viruses, or harmful code
• Violates any applicable law or regulation

5.3 Content Responsibility

You are solely responsible for all content you create or store using Writify. We do not review, endorse, or assume responsibility for User Content.

6.1 Data Processing

Your use of Writify is subject to our Privacy Policy, which describes how we collect, use, and protect your information. The Privacy Policy is incorporated into this Agreement by reference.

6.2 iCloud Drive Storage

Writify saves your documents as standard Markdown files on your iCloud Drive. Your files are stored in your personal iCloud account and are subject to Apple's iCloud Terms of Service and Privacy Policy. You retain full ownership of your files and can access them outside of Writify at any time.

6.3 AI Data Processing

When you use AI writing features, your text input is processed by Apple’s FoundationModels framework entirely on your device. Your content is never sent to Apple’s servers or any third party through this feature. We do not have access to, store, or share the content of your AI interactions. For full details on how your data is handled, please refer to our Privacy Policy.

6.4 Consent to Use of Data

You agree that we may collect and use technical data and related information—including but not limited to technical information about your device, system and application software, and peripherals—that is gathered periodically to facilitate the provision of software updates, product support, and other services to you (if any) related to the App. We may use this information, as long as it is in a form that does not personally identify you, to improve our products or to provide services or technologies to you.

7.1 Third-Party Services

The App may enable access to our and/or third-party services and websites (collectively and individually, "External Services"). You agree to use the External Services at your sole risk. We are not responsible for examining or evaluating the content or accuracy of any third-party External Services, and shall not be liable for any such third-party External Services.

7.2 Information Disclaimer

Data displayed by the App or any External Service, including but not limited to financial, medical, and location information, is for general informational purposes only and is not guaranteed by us or our agents.

7.3 Prohibited Uses

You will not use the External Services in any manner that:

• Is inconsistent with the terms of this Agreement
• Infringes our intellectual property rights or those of any third party
• Harasses, abuses, stalks, threatens, or defames any person or entity

We are not responsible for any such prohibited use by you or any other user.

7.4 Availability and Changes

External Services may not be available in all languages or in your country, and may not be appropriate or available for use in any particular location. To the extent you choose to use such External Services, you are solely responsible for compliance with any applicable laws. We reserve the right to change, suspend, remove, disable, or impose access restrictions or limits on any External Services at any time without notice or liability to you.

8.1 Ownership

Writify and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Mysticbits Oü and its licensors. The App is protected by copyright, trademark, and other laws of both Estonia and foreign countries.

8.2 Restrictions

You may not use our trademarks, logos, or trade dress in connection with any product or service without the prior written consent of Mysticbits Oü.
